For certain aspects of our products and services, we collaborate with or outsource to third parties. These third parties are always carefully selected, and a contract always exists between MarsAI and these third parties that complies with applicable regulations. For instance, MarsAI uses service providers for domain name registrations, email services, SSL certificate providers, cloud connection service providers, website builder service providers, online desktop service providers, and online fax service providers. For more information about our subcontractors, feel free to contact us via the contact details in point 10.
If you purchase a MarsAI product or service from a manufacturer or supplier located outside the European Union, additional measures may be necessary to ensure the security of personal data, such as certification under the EU-US Privacy Shield and/or a processor agreement with standard clauses prepared by the European Commission.
If a person refuses to share their information, it is possible that some services can no longer be offered by MarsAI.
When there is a legal obligation.
In this regard, MarsAI refers to point 4 of this Privacy Policy.
When MarsAI or the relevant third party has a legitimate interest.
This only happens when the interests or fundamental rights and freedoms of the individual concerned do not outweigh this interest.
When MarsAI has received the individual's permission.
If MarsAI provides personal data to third parties in other ways, it will be accompanied by an explanatory communication about the third party, the purposes of the transfer, and processing. Where legally required, MarsAI will obtain explicit and clear consent from the data subject. The data subject always has the option to object (see below).
In the case of international data transfers, MarsAI protects all personal data in accordance with the level of protection required by European legislation.
In some cases, MarsAI uses anonymous, aggregated data for commercial purposes or external reporting. This data cannot be traced back to a specific individual.

As long as you have these rights under applicable legislation, you may exercise certain rights concerning the processing of your personal data against MarsAI.
You can exercise these rights using the contact details provided in point 10 of this Privacy Policy. MarsAI will respond to such requests and, where applicable laws require, will fulfill or deny such requests, in principle, within one (1) month in accordance with applicable laws.

Right to object
You have the right to object at any time to the processing of your personal data in connection with certain situations based on MarsAI's legitimate interest. If you object, MarsAI will no longer process such personal data unless MarsAI demonstrates compelling legitimate grounds for the processing that override your interests, rights, and freedoms or for the establishment, exercise, or defense of legal claims.
Right of access and transparency
You have the right to access your data (free of charge) and obtain a copy of this personal data. You can also request the following:

• The source of the processed data;
• What your rights are.
Right to rectification and erasure
As a data subject, you have the right to have incomplete, incorrect, inappropriate, or outdated personal data corrected or completed. To do so, customer services can be contacted, or your data can be changed via the "marsai.eu" online portal. We ask that you notify us if you change your address to keep your information up to date.
Additionally, you have the right to request the deletion of your personal data, and MarsAI will delete your personal data without delay, but only if and when:
1. The personal data is no longer necessary for the purposes for which it was collected;
2. There is no longer any legal basis for the processing;
3. You object to the processing, and MarsAI has no legitimate grounds for processing;
4. The personal data has been unlawfully processed; or
5. Deletion of the personal data is required for compliance with a legal obligation to which MarsAI is subject.
After complying with the deletion request, MarsAI will send you a confirmation message. In cases of partial deletion, MarsAI will also explain why the request could not be fully fulfilled.
Depending on the nature of the request, it is possible that certain services can no longer be provided by MarsAI. It is also possible that MarsAI may not always be able to delete all the requested data to comply with legal obligations (e.g., to comply with accounting and tax obligations, MarsAI must retain invoice data for up to 7 years).
Right to restrict processing
As a data subject, you also have the right to ask MarsAI to restrict the processing of your personal data if and only if one of the following applies:
1. You dispute the accuracy of the personal data, in which case the processing is restricted for a period that allows MarsAI to verify the accuracy of the personal data;
2. The processing is unlawful, and you oppose the deletion of the personal data and instead request the restriction of its use;
3. MarsAI no longer needs the personal data for processing purposes, but you require it for the establishment, exercise, or defense of legal claims;
4. You have objected to the processing, pending verification of whether MarsAI's legitimate grounds override your interests.
In the event of restriction of processing, the data may still be stored by MarsAI.
Right to data portability
For personal data processed (i) in the context of the performance of the contract, (ii) provided by yourself, and (iii) processed by automated means, as a data subject, you have the right to receive this data from MarsAI in a structured, commonly used, and machine-readable format, and to request that this data be transferred directly to another party, if you wish to change providers, where technically feasible.
8. Retention periods
MarsAI retains and processes your personal data for as long as necessary to achieve the purposes described in point 4.
The retention period may vary depending on the purpose, for example, to comply with legal obligations (e.g., to meet our accounting and tax obligations, MarsAI must retain records for up to 7 years) or up to a maximum of 10 years after the termination of your contract due to the legal necessity to provide certain data as evidence in case of disputes. Access to these archived data is, of course, limited.
